ORDER 1
Application and Interpretation
These Rules may be cited as the Abia State High Court (Civil Procedure) Rules 2009 and shall come into force on the 1st day of July 2009.
The Abia State High Court (Civil Procedure) Rules 2001 are hereby repealed.
(1) These Rules shall apply to all civil proceedings in this court including all Part Heard Causes and Matters.
(2) In respect of causes and matters already pending, the Rules shall apply to every further step to be taken in respect of such causes and matters.
(3) Application of these Rules shall be directed towards the achievement of a just, efficient and speedy dispensation of Justice.
(4) The Forms set out in appendix I in the Schedule to these Rules or Forms as near thereto as circumstances permit shall be used in all cases in which such Forms are applicable.
In the construction of these Rules, unless there is anything in the subject matter or context repugnant thereto, the several words hereinafter mentioned or referred to shall have or include the following meanings, as the case may be:
Alternative Dispute Resolution (ADR) includes Arbitration, Mediation and Conciliation.
