ORDER 1
Citation and Title
1. (1) These rules may be cited as the High Court (Civil Procedure) Rules, 2019 and shall be deemed to have come into force on the 31st day of January, 2019.
Repeal
(2) The High Court Rules 2006 together with all the subsequent amendments to the said Rules are hereby repea1ed. Application
Application
(3) These Rules shall apply to all proceedings including all part-heard causes and matters in respect of steps to be further taken in such causes and matters and in practice shall be directed towards the achievement of a just, efficient and speedy dispensation of justice.
Interpretation Terms
2. (1) These Rules shall be interpreted in accordance with the Interpretation law. Cap. 73 Revised laws of Anambra State 1991 or any re-enactment thereof.
(2) In these Rules, unless the context otherwise requires, the following words and expressions shall bear the meaning assigned thereto-
"Action" means a civil proceeding commenced as may be prescribed by the rules of court or by any law relating to civil proceedings and in force in the State from time to time.
"Administration action" means an action to secure the due administration of trust by the Court
"ADR" means Alternative Dispute Resolution and in the High Court (Civil Procedure) Rules 2019 refer to a collective description of methods of resolving disputes otherwise than through the normal process and in particular to facilitate inspection discovery and interrogatories during the pretrial aspects of cases.
"ADR Processes" means such as but not limited to, Arbitration, Mediation, Mediation-Arbitration, Case or Neutral Evaluation, Private Judging, Mini trial, Statement Procedure, Fast Track, Negotiation would retain the meaning ascribed to them at law.
"AnMDC" means Anambra State Multi-Door Court House, a court-connected Alternative Dispute Resolution (ADR) Centre founded through the Anambra State Judiciary
