Scope and Application of Rules
1. Application of Rules
These Rules shall apply to all proceedings under any law for the recovery of rates, penalties, charges, taxes, expenses, cost of enforcement of statutory provisions, contribution or other like demand and for proceedings for the due enforcement of regulator)' provisions contained in any Law pursuant to Section 28(2) & (3) of the Magistrates' Court Law of Lagos State.
2. Where no Rules exist
Where a matter arises in respect of which inadequate provisions have been made in these Rules, the Court shall adopt the provisions of the
Magistrates' Court Rules or in the absence of any applicable procedure under the Magistrates' Court Rules, the Court shall adopt such procedure as it deems fit to do substantial justice between the parties concerned.
ORDER 2
1. Summary nature of proceedings
(1) Subject to the appropriate authority satisfying the Court that statutory conditions precedent for the enforcement of relevant laws have been complied with, summary proceedings shall be applicable under these Rules, requiring the defendant to show cause why the application by the appropriate authority should not be granted.
(2) All applications under these Rules shall be supported by affidavit stating the facts constituting the grounds and any documentary evidence upon which the applications are made. A defendant has the liberty to file a counter ‐ affidavit and any documentary evidence in response to the affidavit in support of the application.
(3) A defendant's application to show cause shall be filed within seven (7) working days after the service of the application by the appropriate authority.
(4) All applications and affidavits to show cause under these Rules shall be supported by a short statement outlining the legal arguments relied upon by the parties
