AFFIDAVIT IN SUPPORT OF MOTION
I, Adebayo Okonkwo, Male, Muslim, Nigerian, Litigation Manager in the Chambers of Coker & CO., Legal Practitioners of No. 500, Okua Road, Akure, Ondo State do make oath and state as follows:
- I am the Deponent herein and by virtue of my position, I am familiar with the facts of this case.
- I have the prior authority and consent of the Plaintiffs/Applicants to depose to this affidavit.
- Ms. Halima Sule of counsel told me in the chambers around 11.00am on 28th February, 2015 and I verily believe him as follows:
That the Defendant is having its registered/head office at Plot 600, Asokoro, FCT, Abuja, a place outside the jurisdiction of this Honourable Court.
- That the only way by which the Writ of Summons, the Statement of Claim and all other processes in this case could be served on the Defendant easily is for this Honourable Court to appoint Express Mail Services (EMS) Courier Service of the Nigerian Postal Service as a special bailiff to serve all the court processes in this case on the Defendant at Plot 600, Asokoro, FCT, Abuja.
- That it will also eliminate the risk the bailiff of this court will have to face due to traveling over long journey, when there is alternative way of effecting service on the Defendant at Abuja.
- That leave of this Honourable Court must be sought and obtained before the issuance and the service of the Writ of Summons on the Defendant at Abuja.
- That the Plaintiff has good cause of action against the Defendant.
- That the grant of this application will not prejudice the Defendant.
7. I swear to this affidavit conscientiously and in good faith believing same to be true according to the Oath Act.
