AFFIDAVIT IN SUPPORT OF MOTION EX-PARTE
I, Tijani Bello, male, Christian, Nigerian Citizen, farmer of No. 4 Light Avenue, Ikeja Lagos do herby make oath and state as fol4ows:
- I am the Claimant in the suit by virtue of which I became conversant with the facts of this case.
- The facts deposed to are facts which came to my personal knowledge as the Claimant in the suit.
- The Originating processes in the suit herein were sealed in the Registry of this Honourable Court and accordingly handed over to Mr. Wellington, a bailiff of this Court for the purpose of serving same on the Defendant.
- I am informed by My wellington, the bailiff of this Honourable Court and verily believe it to be true that he made five different attempts to serve the documents on the Defendant all to no avail
- The said Mr. Wellington, informed me and I verily believe it to be true that the Defendant has since removed his residence and cannot conveniently be served with the Writ of Summons and other originating processes.
- The lifespan of the Writ of Summons would elapse within the next 2 weeks
- This application is exceedingly necessary to enable the Claimant renew the lifespan of the said document.
- The Defendant will not be prejudiced if this application is granted.
