AFFIDAVIT IN SUPPORT OF MOTION
I, Eric Bassey, Male, Adult, Christian, Nigerian citizen of Suite B2, Bensima House, No. 3 Red Sea Close, Off Aguiyi Ironsi Way Maitama, Abuja.
- I am a legal practitioner in the law office of Pius Garba & Co.
- By virtue of my position, I am conversant with the facts of this case.
- I have the consent and authority of my employer to depose to this affidavit.
- I have been informed by Pius Eze Esq., the lawyer handling the case of the 2nd Defendant and believe him to be true as follows:
- The Court ordered the 2nd Defendant to file his defence.
- His (Pius Eze Esq) father has been seriously sick for long time which coincides with the time within which to file the 2 Defendant's defence. c. At that exact time his father - in - law so had an accident.
- These events necessitated his trips to attend to his ill father and father-in-law.
- That he wanted to file the said Statement of defence but due to the nature of sicknesses of these two important persons around him couldn't have done so.
- The said Statement of Defence is now ready for filing and has been shown to me and is hereby annexed as Exhibit ‗A'.
- The Plaintiff/Respondents will not be prejudiced by the grant of this application.
- It is in the interest of justice to grant this application.
- I depose to this affidavit in good faith and in accordance with Oath Act.
