• I am a Director working with the Defendant/Applicant in this case and by virtue of which I am conversant with the facts of this case.
• The Applicant Respondent instituted this action on _________day of_________2015 without serving the Defendant/Applicant a pre-action notice as required by NNPC Act.
• I believe the action is incompetent as no requisite Pre-action Notice was served on the Defendant.
• I believe the action is statute-barred having been filed outside the 3 months period under the NNPC Act.
