AFFIDAVIT IN SUPPORT OF MOTION

I, Ade Emeka, Adult, Male and a Nigerian Citizen of No 1, xxxxxxx, Lagos do make oath and state as follows:

1. I am the Claimant/Applicant in this suit.
2. By virtue of my position, I am conversant with the fact and circumstances of the suit and other related facts.
3. The Defendant is a financial institution in Nigeria with its registered office at No. 2 xxxxxx Lagos.
4. The Claimant avers that a valid contract was made between the Claimant and the Defendant in March 2019.
5. The Claimant avers that the contract was evidenced in writing.

7. A suit was instituted before this court to enforce the breach of contract and claim on the _____day of_____ 2020.
8. The first 1st Defendant became a no-going concern and was taken over by the second defendant and the 2nd defendant is already taking step towards the winding up of the first defendant.
9. Irreparable damage or injury will be caused to the Claimant/Applicant if the application is not granted.
10. The Claimant/Applicant undertakes to pay all damages caused to the Defendant/Respondent if this application ought not to have been granted.
