I, Ifeoma Okafor, male, businessman, Christian, Nigerian Citizen residing at No. 12, Niyiola Street, Bwari, Abuja, do hereby make oath and states as follows:
- I am the Defendant/Applicant in this case and by virtue of my position, I am conversant with the facts of this case.
- The Plaintiff/Respondent filed an action under the Undefended List Procedure against the Defendant/Applicant on the …….day of ………….2015.
- Order 22 Rule 1 of the Kaduna State (High Court) Civil Procedure Rules specifically requires that an application be made to Court before placing a suit on the undefended list, marking it accordingly and fixing a date for the hearing.
- No such application was made in the instant case rather the Respondent wrote a letter to the Registrar of Court who purported to place the matter under the undefended list.
- I swear to this affidavit solemnly and conscientiously believing same to be true and correct and in accordance with the Oaths Act.
