SAVE AND EXCEPT as is expressly admitted the defendant denies each and every allegation of fact contained in the statement of claim as if same is herein set out and traversed seriatim -

• The Defendant admits paragraph 1, 2, and 3 of the Statement of Claim.
• The Defendant denies paragraph 4, 5, 6 and 7 of the Statement of Claim.
• The defendant states in response to paragraph 4 and 5 of the Statement of Claim that the sum of N9, 000, 000.00 (Nine million Naira only) was paid into the Diamond Bank Account of the Claimant on the 7th day of January, 2013.
• The Defendant states in response to paragraph 6 and 7 of the Statement of Claim that the One thousand bags of Honeywell semolina worth the sum of N1,000,000.00 (One Million Naira) was supplied to the shop of the claimant as balance of payment for the piece of land situate at No. 7 Cedar Street, Lagos Island, Lagos.
• The Defendant avers that he does not owe the Claimant the sum of N6, 000,000.00 (Six million naira) or any amount whatsoever.
• The Defendant states that the Claim of the Claimant be dismissed as it lacks merit.
