On The Effect Of Section 22(1) Of The Land Use Act 1978 On The Holder Of A Statutory Right Of Occupancy
It has been held by this Court that Section 22 (1) of the Land Use Act, 1978 does not prohibit the holder of a statutory right of occupancy from entering into some form of negotiation which may end with a written agreement for presentation to the Governor for his consent, so long as such written agreement is understood and entered into "subject to the consent of the Governor". See: Awojugbagbe Light Ind. Vs. Chinukwe (supra) at 435 – 436 G – A. It was also held that there will be no contravention of Section 22 (1) by the mere fact that such agreement was executed before being forwarded to the Governor for his consent.
