Kaduna State (Sharia Court of Appeal) Rules, 2024

Citation and Commencement

1. These Rules may be cited as the Sharia Court of Appeal Rules of Kaduna State, 2024, and shall come into operation on the 2nd May, 2024.

Interpretation

2. In these Rules:

“The Court” means the Sharia Court of Appeal;

“The court below” means Upper Sharia Court from which the appeal is brought and any other Sharia Court in case of Judicial Review.

Publication of notice of session and cause list

1. (1) Notice of the date, time and place of the com- mencement of a session of the Court together with a cause list of the cases to be heard at such session shall be published by the Regis- trar of the Court in the notice board of vari- ous Sharia Court of Appeal Divisions not less than three (3) weeks before the date appointed for the session.(2) In case of urgency where the giving of three (3) weeks' notice is not practicable, the Reg- istrar with the approval of the Grand Kadi may publish a notice and cause list on the notice board of Sharia Court of Appeal Divi- sions not less than one (1) week before the date appointed for the session.

(3) The Court may, with the consent of both par- ties signi ed in writing, hear an appeal and deal with any other matter whether or not the same has been included in any published cause list.

Entry of appeal

1. (1) When an appeal is brought against an order or decision of the court below such appeal shall be entered in the registry of the Court nearest to the court below.
