Ogun State Customary Court of Appeal Rules, 2022

Citation and Commencement

1. These Rules may be cited as the Ogun State Customary Court of Appeal Rules, 2022 and shall come into operation on………………day of …………………… 2022.

Application

2. (i) The Rules shall apply to all civil proceedings in all matters in which the Ogun State Customary Court of Appeal has been conferred with Jurisdiction.

(ii) Application of the Rules shall be directed towards the attainment of just, efficient, effective and speedy dispensation of justice

Interpretation of terms

3. In these Rules, unless it is otherwise expressly provided or required by the context:

"The Law" means the Customary Court of Appeal Law of Ogun State, 2011 or any re-enactment thereof;

"Appeal" means any issue for determination before the Court emanating from the decision of the Lower Court and includes an Application for Leave toAppeal.

"Appellant" means any person who desires to Appeal or Appeals from a decision of the Lower Court or who applies for leave to so Appeal and includes the Legal Practitioner representing such a person in that behalf.

"Cause" Includes any action, suit or other proceedings between an Appellant and a Respondent or any Applicant and a Respondent; or any Claimant and a Defendant.

"Chief Registrar" means the Chief Registrar of the Court and any of his deputies.

"Constitution" means the Constitution of the Federal Republic of Nigeria 1999."The Court" means the Customary Court of Appeal, Ogun State established pursuant to the provisions of Section 280 of the Constitution of the Federal Republic of Nigeria 1999 and Section 3 (1) and (2) of the Customary Court of Appeal Law, 2011."The Court of Appeal" means the Court of Appeal of Nigeria.
