AFFIDAVIT IN SUPPORT OF MOTION FOR JOINDER

I, Ade Emeka, Adult, Male, Clerk and a Nigerian Citizen of No 1, xxxxxxx, Lagos do make oath and state as follows:

1. I am a Clerk in the office of the Claimant/Applicant in this suit by virtue of which I am conversant with the facts stated in the Statement of Claim.
2. I have the authority of the Applicant to depose to this affidavit.
3. In March, 2019 the Claimant/Applicant entered into a contract in Lagos with the Defendant/Respondent to supply five hundred tons of Cashew nut worth N5,000,000:00 (Five million Naira) only to the Bank for onward exportation to China.
4. The term of the contract is that down payment of 3,000,000:O0 will, be made before the exportation and that the balance will be paid when the goods reach its destination.
