THE PETITION OF CHIEF ROCHAS BENSON OF OLUMI WEST LOCAL GOVERNMENT AREA OF DELTA STATE, WHOSE NAME IS SUBSCRIBED
- Your Petitioner, Chief Rochas Benson of Olumi west local government area, Delta State was a candidate at the above election. He was validly nominated by his political party, Masses Democratic Congress (MDC) as a candidate to the office of the President of the Federal Republic of Nigeria
- And your petitioner states that the election was scheduled to be held on Saturday, 14th February, 2015 when the following were scored:

- GROUNDS FOR PETITION
Your Petitioner states that the grounds on which he relies for the petitioner are as follows:
- The 1st Respondent was not duly elected by a majority of lawful votes cast
- The election was marred by irregularities, corrupt practices and noncompliance with the provisions of the Electoral Act, 2010.
- FACTS IN SUPPORT OF THE PETITION
- Your Petitioner states that election did not take place in the North East region of the Country.
- Though the election was scheduled for 8am to 4pm, the 2nd Respondent did not provide vital election materials in the South-South region of the Country up until about 3pm on the 14th day of February, 2013.
- The 2nd Respondent did not supply the following election materials:
- Voters register for use in over ZGO palling booths in Lagos State.
- Results sheets for the Presidential election at the respective polling units.
- RELIEFS/PRAYERS
WHEREOF your Petitioner prays the Court of Appeal for the following reliefs:
- Declaration that the 1st Respondent, Mr Uche Robinson was not duly elected and returned as winner of the election to the office of the Federal Republic of Nigeria held on 14th February, 2015.
- AN ORDER DECLARING the election to the office of the president of the
Federal Republic of Nigeria held on 14th February, 2015 as null and void
